> Suspension hearings can be called based on both alleged on-ice and off-ice events.
> Individuals subject to a hearing will be notified in writing by the District 4 Chairperson.
> For on-ice incidents (i.e.: a match penalty) a hearing shall be scheduled and conducted within thirty (30) days of the incident.
> If the person(s) under suspension or facing suspension refuses to attend or fails to appear at a scheduled hearing, the District 4 Chairperson will notify the persons(s) in writing of an indefinite suspension until they appear before a scheduled Hearing Panel.
> The Hearing Panel will consist of the District 4 Council and will include a minimum of three (3) persons reasonably disinterested and impartial.
> At the hearing, the suspended/charged individual(s) will be asked to testify to the facts of the allegation. If the hearing is a result of an on-ice incident, the reporting referees will also be asked to testify to the facts. Additional individuals who have direct relevant information to the incident may also attend and testify.
> A suspended/charged individual(s) may bring an attorney with them to the hearing. The attorney is not a part of the hearing, but is allowed to sit in on the hearing. The attorney does not have the right to cross examine witnesses or otherwise make statements unless they were directly involved in the incident.
>All hearings are tape recorded so that the facts of the case can be reviewed by the MAHA Appeals Committee, if necessary.
> The Hearing Panel may hear any evidence that it believes is relevant to the issue(s) at hand. The Panel may place limits on time, evidence, and documentation. The Panel may have witnesses and/or written statements.
> The “Rules of Evidence” in judicial proceedings shall not apply to the hearing. The “Burden of Proof” is that the charges are more likely true than not true, otherwise referred to as “preponderance of evidence” standard.
> At the conclusion of the hearing, the Hearing Panel will deliberate based on the evidence presented. The Panel will impose a suspension ranging from dismissal, not guilty, probation (with or without limits), up to a life time suspension.
> The Hearing Panel has five (5) business days after the close of the hearing to render its decision to the parties to the hearing. Decisions of the Hearing Panel are normally announced after the conclusion of the hearing/deliberations.
> The suspended individual(s) has the right to appeal. The Hearing Panel will provide the affected person(s) a copy of the MAHA Appeals Procedure.
> Refer to the MAHA Annual Guide and USA Hockey Annual Guide for more information and the complete rules/procedures.
